Terms of Use
Pensum · valid from 26 September 2026 · Deutsch
These terms apply when you use the Pensum app, the Pensum Plus subscription, and pensumapp.com. How your data is handled is explained in the Privacy Policy.
Provider: Alessandro Parini, Einzelfirma, Grienmattweg 1, 4410 Liestal, Switzerland (UID CHE-181.827.819). Contact: [email protected]. In these terms, "we" and "us" mean this provider, and "you" means the person using Pensum.
1. What Pensum is
Pensum is a nutrition tracker. You log food, weight and targets, and the app shows estimates such as your energy expenditure. The app is free and needs no account. Your diary is stored on your device. Pensum Plus is an optional paid subscription with the extras described in section 5.
2. Not medical advice
Pensum is a tool for tracking and self-reflection. It is not a medical device, and it does not diagnose, treat or prevent any disease. Calorie and nutrient values, targets, expenditure estimates, goal projections, AI estimates and Ask Pensum answers are estimates, and they can be wrong. Check the values that matter to you. Pensum does not replace a doctor, a dietitian or another qualified professional.
Talk to a professional before you change your diet if you are pregnant or breastfeeding, have a medical condition, take medication that affects appetite or weight, or have or have had an eating disorder.
3. Who can use Pensum
You must be at least 16 years old. If you are not yet of legal age where you live, you need the consent of a parent or guardian to buy Pensum Plus.
4. AI features
Some optional features send a photo, text, or selected data to an AI model to produce an estimate or an answer. The Privacy Policy (section 3) describes exactly what is sent. Results are suggestions: you review them and can correct them before anything is logged, and you decide what goes into your diary. Only send content you are allowed to share, and nothing unlawful.
The free version includes a monthly allowance of AI actions, shown in the app. Pensum Plus includes unlimited AI actions for normal personal use. Technical safeguards against automated or abusive use apply to every plan; they do not affect normal use. We may change the AI models we use, as long as the features keep working as described.
5. Pensum Plus
What is included. The features listed on the Pensum Plus screen when you subscribe, currently unlimited AI actions and automatic cloud backup. Tracking itself never requires Plus.
Buying. Pensum Plus is sold through Google Play. The price, the billing period and any introductory offer are shown before you confirm. Google Play processes the payment, and Google Play's terms apply to the purchase. In the EU/EEA and the UK, Google sells Plus as merchant of record. Everywhere else, including Switzerland, you buy it from us, and Google processes the payment.
Renewal and cancelling. Plus renews automatically at the end of each period until you cancel. You can cancel at any time in Google Play (Play Store > your profile > Payments & subscriptions > Subscriptions). Uninstalling the app does not cancel the subscription. After you cancel, Plus stays active until the end of the period you paid for. If the price changes, Google Play informs you in advance and asks for your consent where the law or its rules require it.
Refunds and withdrawal. Your statutory rights as a consumer are not affected. For purchases in the EU/EEA and the UK, Google handles the statutory right of withdrawal and refund requests under the Google Play refund policy. Swiss law gives no statutory right of withdrawal for online purchases; the Google Play refund policy applies there too. Either way, you can write to us: if Plus did not work as described, we fix it or refund you.
Restoring. Plus is linked to the Google account you bought it with. After a reinstall or on a new phone, use "Restore purchase" in the app.
6. Cloud backup
The Plus cloud backup helps you get your diary back after you lose or replace your phone. What is uploaded, where it is stored and for how long is described in the Privacy Policy (section 7). We take care that backups stay available and intact, but we cannot promise that every backup can always be restored. For data that matters to you, also keep your own backup file (Settings > App > Backup & restore). When your subscription ends, stored backups are kept for 12 months and then deleted.
7. Your data and your content
Your diary belongs to you. You can export it at any time, and delete it by uninstalling the app and deleting your cloud backups. You keep all rights to the photos, text and foods you create. You give us only the rights we need to process them for the feature you use.
Open Food Facts contributions. If you choose to contribute a product after a label scan, its name, the values you confirmed and the label photos are published on Open Food Facts, a public database. By confirming, you agree that they are published there under Open Food Facts' licences (Open Database License for data, Creative Commons BY-SA 3.0 for photos), and you confirm that you took the photos or may share them. Once published, a contribution is managed by Open Food Facts, and we cannot remove it.
8. Fair use
Use Pensum for your own personal purposes. Do not:
- access our servers other than through the app or this website;
- automate requests, scrape data, or resell AI features or data;
- try to get around usage limits or the subscription check;
- disrupt the service or harm other users;
- reverse engineer the app, except where the law expressly allows it.
If an install seriously breaches these rules, we may restrict its access to the online features.
9. Licence and food data
We give you a personal, non-exclusive, non-transferable right to use the app under these terms. The app, its design and its texts are ours. Food data comes from open databases under their own licences, listed in the app under About & sources; those licences apply to that data.
10. Availability and changes to Pensum
We develop Pensum continuously and may change, improve or remove features of the free app. Online features (AI, cloud backup, online food search) depend on servers and third-party services, and can be temporarily unavailable, for example during maintenance or an outage.
We change what Pensum Plus includes only for a valid reason, such as new legal requirements, security, changes by our service providers, or technical development, and never at extra cost to you. If a change noticeably reduces what you get, we tell you in advance. You may then end your subscription within 30 days of the change, and we refund the unused part of the period you already paid for. If we ever stop offering Pensum Plus, we tell you at least 30 days in advance and refund any unused prepaid period. Your diary stays on your phone either way.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and wherever mandatory law, such as product liability law, requires it.
For slight negligence, we are liable only if we breach an obligation that is essential to the contract and that you may regularly rely on. Our liability is then limited to the damage that was foreseeable and typical when the contract was made.
The free features are provided at no cost. For them, apart from the cases in the first paragraph of this section, we are liable only for intent and gross negligence.
If data is lost, we are liable only for the effort of restoring it from backups you keep at reasonable intervals. This does not limit what we owe you for the Plus cloud backup itself.
12. Changes to these terms
We may update these terms, for example when we add features or the law changes. The date at the top shows the current version. We announce material changes in the app or on this website before they take effect. Changes that affect an existing Plus subscription apply from its next renewal at the earliest, and at least 30 days after we have told you. If you do not agree, you can cancel before then.
13. Governing law and disputes
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of that country.
As a consumer, you can take legal action in the courts where you live, and we can take legal action against you only there. For businesses, the place of jurisdiction is Liestal, Switzerland.
If something goes wrong, please write to us first; most things can be solved by email. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
If one provision of these terms is invalid, the rest remain in force. These terms are available in English and German. Both say the same; if they ever differ, the version in the language you use Pensum in applies.
